1. SCOPE
These General Terms and Conditions apply to the sale and delivery of goods by R-W Reiner Wein GmbH, with its registered office and business address at Elßlergasse 20/3, A-1130 Vienna. Unless expressly agreed otherwise, our General Terms and Conditions made known to the contractual partner shall apply. The contract language is German.
2. OFFER
Our offer is subject to change and is only valid while stocks last. Due to limited quantities of individual goods, there may be a sell-out situation during your online order. In this case, we take the liberty of offering you alternative products. Our current GTC are exclusively authoritative for the delivery. Deviating agreements are only valid if they are confirmed by us in writing.
3. ORDER
3.1. The customer’s order constitutes an offer. A contract is only concluded after acceptance on our part. The customer will be notified of our acceptance by e-mail or by telephone. If we are unable to fulfill the customer’s order for any reason, the customer will be notified immediately.
3.2. The acceptance of orders is subject to delivery possibilities. R-W Reiner Wein GmbH reserves the right to allocate smaller quantities to purchasers if a product is oversubscribed.
4. PRICE
4.1. The prices are in Euro per piece, including all legal duties and taxes (VAT), but the prices refer only to the goods themselves and do not include shipping costs. All costs arising from shipping, including any import or export details, shall be borne by the buyer. The buyer will be charged for all delivery costs actually incurred – these will be displayed when ordering in the Internet online store after correct selection in the shopping cart, and shown in an order confirmation issued by Weinmanufaktur Eisenberg. The above amounts may be unilaterally changed by Weinmanufaktur Eisenberg for future contracts at any time. In the event of typographical, printing or calculation errors on the website, we are entitled to withdraw from the contract.
4.2. Prices are based on costs at the time of initial price quotation. Should the costs change by the time the buyer places an order, Weinmanufaktur Eisenberg is entitled to adjust the prices accordingly.
5. PAYMENT
5.1. R-W Reiner Wein GmbH retains ownership of all goods until full payment of the purchase price including additional charges.
5.2. R-W Reiner Wein GmbH accepts payment by credit card immediately upon conclusion of the contract or by advance payment. The bank details are as follows

As soon as we receive the confirmation or payment, the order will be sent to the specified delivery address.
6. DELIVERY
6.1. R-W Reiner Wein GmbH charges transport costs for each order quantity in addition to the designated prices. The amount of the current shipping costs is still displayed during the ordering process as well as in the order confirmation. In the case of delivery of the goods, use and risk shall pass to the Buyer at the latest upon handover to the Buyer or the Buyer’s representative.
6.2. For deliveries in European countries, the actual delivery costs will be charged – these will be displayed in the shopping cart after correct selection.
6.3. In case of a desired delivery to a non-EEA country, the consumer has to contact R-W Reiner Wein GmbH directly to request a desired delivery.
6.4. The delivery is carried out by a service commissioned by R-W Reiner Wein GmbH at customary business hours. In the case of non-acceptance of ordered goods, R-W Reiner Wein GmbH is entitled to demand compensation for the additional expenses incurred as a result, such as urgent transport costs.
7. TRANSPORT DAMAGE
For damages and impairments that occur during transport, R-W Reiner Wein GmbH guarantees full replacement under the following conditions: The incoming goods are to be checked immediately for correctness and completeness and any complaints are to be reported immediately. Any complaints must be confirmed by the carrier.
8. WARRANTY
8.1. Complaints based on legal warranty claims can be made to the following address:

8.2. Customary or minor deviations in quality, quantity, color, size, weight, equipment or design due to technical reasons do not constitute warranty defects or non-performance of the contract. The formation of tartar is a natural process and therefore does not constitute a complaint or warranty case.
9. EDP PROCESSING AND CUSTOMER DATA
The buyer agrees that the data specified in the purchase contract and disclosed during registration will be stored and processed in compliance with the provisions of the Data Protection Act. This data is used, to the extent necessary in each case, to comply with legal requirements and to process payment transactions.
10. OTHER PROVISIONS
10.1. If individual provisions of these General Terms and Conditions are invalid, this shall not result in the invalidity of the entire contract. The remaining content of the contract remains unchanged.
10.2. The place of performance is Vienna. For all legal disputes, the contracting parties – insofar as they are not consumers – shall submit to the District Court of Vienna, which shall have exclusive jurisdiction, irrespective of the amount in dispute.
10.3. The contract shall be governed by Austrian law to the exclusion of the UN Convention on Contracts for the International Sale of Goods and to the exclusion of the conflict of law rules.
